Wow, that's an awfully unlikely scenario.

How about this for a scenario: a player is in time pressure, so his opponent steals a pip, hoping the guy will grab the dice in haste and then there's nothing that can be done about it.

If our goal is to write the rules so that no one can ever take a shot, we can never write the rules. I prefer to focus on the 99% of the time no one is taking the shot, and say that it is better for illegal moves to be corrected than to enforce a needless formalism.
