What I think it comes from is Bill Riles's statement at the outset:
The tournament will archive all resultant match files but will not commercialize the match files in any way. The tournament will also not make any match files public unless specifically authorized to do so by both participants of a given match. Obviously, streamed matches enter the public domain. [emphasis mine]
Logically, it would probably have made more sense to announce that match files of non-streamed matches would not be made public without consent, and perhaps that was even the intent. Given the stated policy, though, I can see why anyone officially associated with the tournament would feel that a contract had been implicitly made and that they were bound to honor it, even in the absence of any other legal restrictions.
