I agree this distinction may be important in refining the current 'legal moves' rule. The situation that Bob points out in this thread deserves serious consideration:

What would happen if, in a legal moves tournament, a player moves checkers with two hands on a given roll...his opponent sees it but doesn't care, and the game proceeds as normal. A spectator reports this outrageous breach of protocol to the TD. Everyone involved agrees on the facts. Does the TD have the right to roll back the match to the position before the infraction? How would this even be possible in an unrecorded match? Could anyone possibly think it is a fair outcome to penalize the player that failed to correct his opponent's illegal 2-handed move? What a mess.
