Legal moves and first-order/second-order rules

Though I would lean towards calling it a first-order rule, the reason I consider it to be a borderline case is that it governs a situation that comes up relatively rarely. Thus it is quite possible to play the game, not just once but many times, without ever being aware of the rule.

I believe it was Korchnoi who once asked an arbiter in a top-level tournament game whether it was legal to castle with a rook that was under attack. You would probably categorize this as a first-order rule but it is certainly possible to play chess at a world championship level without ever being clear on this point.
