I do not think that the purpose of breaks is for players to try gain some psychological advantage. From my experience, players rarely have a problem agreeing on a convenient time for a break. If there is an issue, the 45 minute rule (or something similar) resolves it sensibly. It is difficult for me to understand why you would think this "extremely" unfair, or even moderately unfair for that matter.

If situations arise where a player desires to have an additional short break (typically a toilet break), the TD may always apply his discretion in making the decision.
