That's not the intention of the rule (imnsho of course) and any TD who was donkey enough to see it that way I'm not sure I'd want to be involved in their tournaments.
An opponent could bring the following objections to the TD:
1. The transcription process is visually irritating and is putting him off his stride.
2. The transcriber might be using the capacity to write notes as a mechanism to illegally assist his game, by, for example, keeping a running pip count tally.
3. There's a clear and utterly unambiguous rule denying players the right to record anything unrelated to the score by any means whatsoever.
IMNSHO, The real "donkey" would the TD who used the escape clause of 1.1. to override the evident facts here (as much as he might personally sympathise with the transcriber's pure motivations).
