Mary was very clear to say that the game must be played our normally. A settlement involves ending the game. Two completely different situations.

Any agreement in tournament play in which one player does not attempt to win is absolutely in violation of the rules. As has been pointed out before, you cannot prevent a player from defaulting a match. There are many valid reasons to do so -- travel considerations and illness are probably the most common. But any agreement that make it better for a player to default than to win should be questioned. If it's determined to be collusion, there could be grounds for defaulting BOTH players.
