They should not speak up to the players no matter what -- even if they see out-and-out cheating. (They can go to the TD.)

By the time a spectator finds the director and explains the situation, the position is long gone. For serious tournament games maybe would be possible to assaign someone to be the "speaker upper" and only that person be allowed to speak up if something illegal happens. Along with a video recording of the match for rewind and review would seem to me a reasonable way reduce the chances of a game played with illegal moves. Whether intentional or not i think its a bad outcome for any game to be played on with an illegal move. Every effort should be make to avoid it.
