Well, the difference is that there is no source code for the neural net - it was generated, not written. And because of the nature of neural nets in general and the complexity of bg nets in particular I'd say it's impossible to use part of the net, while replacing another part.
So unless XG makes the same moves in all situations you have to admit that it's a different net. Even if Xavier took the GNU net and added some training to it (which would be violation of GPL), retraining it could and probably would impact the way it's evaluating positions like the ones Murat is showing.
Unless you found a way to UNTERSTAND how the neural net evaluates positions (which would possibly allow to replace a part without retraining the whole thing) I stand by what I said: you can't prove GPL violation by comparing positions.
