"Dead" cube illegal?

I tend to disagree for this case. The TD is effectively following the letter of the law and making that decision based on what the rules say. In this case the issue is so obvious, why not take that decision away with a minor amendment. Some people may see great value in a TD who stands by the letter of the rules. As someone who has run events (not BG), I believe a host's discretion to make rulings based on fairness and sportsmanship are sometimes needed. So I wouldn't be one of those TD's that would allow it to go this way. In my case as a BG TD, the dead cube rule is one that I would amend if I use the old rules. In the new rules I would add a dead cube rule where none exists presently.
How many people would not go to a TD's event who chose to amend "dead cube" rules so that a player on turn with enough points to win at the current cube level was considered to have a dead cube?
As for the "dead cube rule" itself, it isn't like we haven't discussed this rule before. Back last September this same rule came into question. Not so coincidentally it seems - you and I were actively discussing it then too. I think when people have to ask on this forum about a rule over and over, I think it might be a time for that rule to be looked at. It just so happens that amending the dead cube rule can make it impossible for a match to end on a drop.
Interestingly enough this whole idea of the dead cube has come up even among the social tournament hosts on SHG. One example of this was this forum thread for MadHouse. They also appear to have asked Phil for his opinion.
