I think the "compromise" should be something like this: The player that wants to shuffle MUST say something to alert the opponent about his intentions. He can just say "shuffle" or "just looking" or something like that. It would be similar to the "J'adoube" in chess. Then the opponent will pay more attention to the shuffling or he can take pictures or write down the original position, if he wants.
