Not with a tournament of exactly 256. The fighter's bracket works out perfectly with 16(2 to the 4th) or 256(2 to the 8th). The next number of players up with a perfect fighters bracket is 2 to the 16th.
"Is it the winner of the fighter's bracket that you feel this is unfair to? If you want to have the undefeated bracket winner have 50% equity to win the tournament you could just have a single game between that player and the fighter's bracket winner and save a round."
It is more fair to the winner of the fighters bracket when compared to the traditional double elimination bracket. If all matches are a 50/50 proposition, the one match final gives each of the final 3 exactly the same chance to win the tournament as my format. I like the idea of a double elimination tournament where you can't be eliminated with just one loss. The one match final format is not a double elimination tournament.

Say first is N, 2nd is N/2 and third is N/4. If there is a tie for 2nd/3rd they should just split and get 3N/8. "
The above format is how I would run a double elimination tournament if I was a ABT tournament director. If I was simply the director, I would have no power to change the rules for ABT points. I do think that giving 8x ABT points to the winner of a tournament and 3x for 2nd is to much of a spread.
