If it's obvious from the context that he knows he can hit, and he picks up the checker immediately after the dice as opposed to before, to me that feels like a mechanical error, similar to putting your own checker on the bar rather than the other guy's. Since it's a legal move, it's within the rules to let it stand. Personally, I wouldn't want to win that way. In a chouette, with partners who are perfectly happy to win that way, a settlement seems like the best resolution.
What this example says to me is simply that legal moves, which I favor, is still not a perfect solution to every situation. I still support legal moves because it would be an improvement over the status quo. Maybe someday someone will propose an even better solution.
