If I ask someone if they want to play legal moves and they say "no" then we aren't playing legal moves, PERIOD.

However, here the language barrier is an issue and 1) the player may be willing to play legal moves if he really understood what it meant and 2) language may be such an issue that the player can't really understand what you're saying if he makes an illegal move or speak well enough to correct your illegal move. So here is an issue, although you could have someone else who speaks his language explain it to him and likely you could play legal moves.
