#1 is cocked not because it touches the side, but because it isn't flat. One can plainly see that the die is angled due to partially being in the gap between two checkers.

#2 I'd need a close up to be sure whether it is flat or not. Sometimes we need to look closely under the old rules to see whether a die is angled up due to touching the side or a checker.

#3 is easily seen as cocked, of course as it isn't flat.
