Would a grammatical error be cheating, by breaking the rules of the English language?

Yes, with respect to item 5 in your list. Driving 56 miles per hour when the speed limit is 55 miles per hour is also cheating with respect to item 5 in your list. Neither action is liable to have consequences, unless you are taking an English test.

If Jason had simply said "Ed cheats" and provided no other context then I agree that that could be considered inflammatory. However, Jason in his post said clearly that he considers cheating a violation of the rules and regulations, and further qualified that he did not equate cheating with malice. Once he made this qualification it is clear that this could only apply to the fifth definition.

Granted that this is not the most widely used meaning of the word- but again, Jason gave the context of his word usage.

I've been playing against Ed regularly for about eight years, and although he is the sloppiest player I have ever played with respect to adherence to the procedural rules of the game, I do not for one second think he does this out of malice. He has good intentions and a good heart.

Jason is a real stickler for the rules and I find no fault in that, in fact I consider it virtuous. Perhaps he could have been more diplomatic in how he worded things, but I think the main intent of his post was to say, "Hey, c'mon, people, let's follow the rules better so that the game is clean and we have fewer disputes", not to say "Ed cheats".
