Asymmetrical does not equal unfair. Since both players stand an equal chance of becoming the leader who benefits from the protection, it is not unfair. It is just asymmetrical, as is the Crawford rule. Match play by its very nature is asymmetrical in many ways.
Fundamentally, the argument here is the same as the argument against Legal Moves (and your argument is no less valid) - that being why not always hold people responsible for these situations. The answer is that there are two opposing philosophies, and one of them must be chosen and should then be followed consistently. This rule set has chosen the Legal Moves philosophy where we expect the players to perform basic validation of inputs and to prevent these kinds of things from occurring, just like a computer program would. People fall into one philosophical camp the other. There is no right or wrong, just preference. But the rules must pick one.
