use of video camera vs other camera

" Use of personal electronic devices is restricted to recording or clocking the match, scorekeeping, noise cancelling, and music-listening purposes. If in use, a player’s clock must run while they take pictures, except during breaks"
A video camera is constantly taking pictures and thus would not be allowed. I think though that the intent is to allow them in the rules or would that be a tournament policy? If they are allowed I think it is unfair that that they can be used freely whereas a non video camera would have to be used only while clock is running. Note that an interesting checker play from opponent would literally be impossible to get a picture of. I think I heard it as some sort of distraction argument but couldn't a video camera hanging overhead be as much a distraction?
Could the whole issue be evaded by instead of taking a "picture" setting the camera to video mode?
