That's not the intent of that part of the rule. The intent is to address gin positions. Specifically, the intent is that if someone's flag falls when there is no sequence of rolls where they would not win the match, they should win the match.

Let's say a player is down to 3 seconds reserve, and has 6 checkers on the ace. Opp has only 1 off. If opp does not concede, and player cocks the dice 3 times in a row and times out, the authors of the rules are saying the player should still win, despite the time out.
